General Terms and Conditions of Sale

1. General Provisions

1.1 Contracting Party

These general terms and conditions of sale govern all commercial transactions concluded between the online shop www.tentations.ch, represented by the sole proprietorship Shop4Fun Monnard, registered in Switzerland under the IDE number: CHE-157.066.250, hereinafter referred to as "the Seller", and any person making a purchase on the website www.tentations.ch, hereinafter referred to as "the Customer".

1.2 Modifications

The Seller reserves the right to modify these general terms and conditions of sale at any time. The applicable conditions are those in effect at the time of the order.

1.3 Acceptance

By confirming their order, the Customer acknowledges having read, understood, and accepted the general terms and conditions of sale below. He also acknowledges having reached the age of 18 at the time of the order.

2. Products and Orders

2.1 Product Description

The products offered for sale are described in detail on the website www.tentations.ch. The Seller strives to provide accurate and up-to-date information about its products but cannot guarantee the absence of errors or omissions. The details presented in the media (photos, videos, etc.) depicting the items may differ from the supplied product and are non-contractual. The decoration elements shown in the images are not part of the sold product.

2.2 Order Process

The order process is detailed on the website. The Customer is invited to carefully check their order before confirming it. Any confirmed order is considered firm and definitive.

3. Prices and Payment

3.1 Pricing

The prices of the products are indicated in Swiss francs (CHF) and include the applicable VAT. As of today, we are not subject to VAT, so the amount is 0%. Delivery costs, if any, are specified during the ordering process.

For orders with an amount less than CHF 20.00, an additional fee of CHF 9.90 will be charged.

For orders with an amount between CHF 20.00 and CHF 50.00, an additional fee of CHF 6.90 will be charged.

For any order with an amount equal to or greater than CHF 50.00, no additional fee will be charged.

The Seller reserves the right to change its prices at any time.

3.2 Payment Methods

Payment is made online at the time of order. The accepted payment methods are:

- bank cards

- TWINT

- bank transfers

Payment information is processed securely, and the Seller does not retain the Customer's banking data.

3.3 Loyalty Points

A loyalty points system is in place for registered customers. "Guests" and "visitors" do not have access to loyalty points.

Loyalty points are awarded differently based on the "tier" reached by the customer. Each tier requires the customer to accumulate a specific number of points.

- **Iron** :

  • between 0 and 250 points accumulated
  • Earn 1 point for every CHF 1.50 spent

- **Bronze** :

  • between 250 and 500 points accumulated
  • Earn 1 point for every CHF 1.40 spent

- **Silver** :

  • between 500 and 750 points accumulated
  • Earn 1 point for every CHF 1.25 spent

- **Gold** :

  • between 750 and 1000 points accumulated
  • Earn 1 point for every CHF 1.15 spent

- **Platinum** :

  • between 1000 and 1250 points accumulated
  • Earn 1 point for every CHF 1.00 spent

- **Diamond** :

  • More than 1250 points accumulated
  • Earn 1 point for every CHF 0.90 spent

It is not possible to combine the use of loyalty points with a promo code.

The minimum cart value must be CHF 80.- to use loyalty points.

Loyalty points are valid for 365 days.

Each loyalty point is worth CHF 0.05. (100 points = CHF 5.-).

When loyalty points are used, the ‘tier’ adjusts and returns to the level corresponding to the new points balance.

The seller reserves the right to terminate the loyalty programme without notice. In such a case, the customer's outstanding loyalty points will be converted into a purchase voucher, based on the value at the time of termination of the programme.

4. Delivery and Deadlines

4.1 Shipping

Our items are sold throughout Switzerland. The Seller undertakes to ship the products as soon as possible after the order is confirmed. The estimated delivery times are communicated to the Customer. The usual time is between 4-6 working days, but delays may occur independently of the Seller's will (strikes, wars, pandemics, natural disasters, supplier delivery stops, etc.).

Our main logistics centre is located in France. In some cases, and for logistical reasons, the order may be shipped directly from the warehouse in France. In these cases, the sender on the label will be ‘NET-COMMUNICATION’. In this case, the parcel must be signed for.

The Customer will not be billed for any additional costs relating to customs clearance or product importation in addition to the payment made at the time of ordering, even if the indication of a separate invoice by the Post Office appears on the shipping label. Should such a case nevertheless arise, please contact our customer service department ‘contact@tentations.ch’ immediately so that we can take charge of these costs.

A copy of the invoice will be requested and only this, after verification with the Swiss Post Office, will be processed by our services. WE WILL NOT MAKE ANY REFUNDS DIRECTLY TO THE CUSTOMER

4.2 Delays and Solutions

In the event of a significant delay, the Customer will be informed, and alternative solutions will be considered, such as partial reimbursement of delivery costs.

4.3 Verification

The Customer is required to check the condition of the packaging and the goods sold upon receipt. Any damage or missing product must be reported immediately to our customer service, which will take the necessary measures.

4.4 Shipments not collected

When a parcel is sent against a signature, the Customer must sign for and confirm receipt of the parcel with the Post Office. If the Customer is not present when the delivery person arrives, the usual procedure of the Swiss Post will apply. If a parcel is not received by the Customer within the legal time limit set by the Post Office, the order will be returned to the sender or to the Seller. The Customer will be informed by email and the order will then be held for a maximum of 30 days and the cost of returning it will be invoiced to the Customer. In order to be able to collect their order, the Customer must first pay the return costs as well as the new delivery costs required to return the order. At the end of the 30-day period, the order is considered to have been refused by the Customer and the products will once again become the property of the Vendor. In this case, no refund will be given to the Customer.

The Vendor reserves the right to charge any additional costs incurred by keeping the returned order pending recovery by the Customer.

5. Right of Withdrawal and Returns

5.1 Withdrawal Period

In accordance with the legislation in force, the Customer has a period of 14 days from the receipt of the products to exercise their right of withdrawal. The return costs are borne by the customer. For reasons of hygiene and health protection, only unopened items in their original packaging can be exchanged or refunded. Each item will be checked before proceeding with the refund.

5.2 Return Conditions

Returned products must be in their original condition, unused, and accompanied by all accessories and documents. The return costs are borne by the Customer, except in the case of a defective product or a delivery error attributable to the Seller. See the details on the specific returns policy page.

6. Warranties and Liability

6.1 Legal Warranties

The products sold are covered by the legal warranty of conformity and the warranty against hidden defects in accordance with Swiss legislation.

6.2 Limited Liability

The Seller's liability is limited to the amount of the order. The Seller cannot be held liable for indirect damages, loss of profit, or any other financial loss suffered by the Customer.

7. Protection of Personal Data

7.1 Confidentiality

The Seller undertakes to respect the confidentiality of the personal data provided by the Customer. The collected information is used only in the context of order management and is protected in accordance with the data protection laws in force in Switzerland.

7.2 Exercise of Rights

The Customer can exercise their rights concerning their personal data by contacting the Seller.

8. Applicable Law and Jurisdiction

8.1 Applicable Law

These general terms and conditions of sale are subject to Swiss law.

8.2 Competent Jurisdiction

Any dispute relating to these general terms and conditions of sale will be subject to a prior attempt at conciliation with the company Shop4Fun Monnard before any legal action.
